1. Acceptance
These Terms of Service govern your use of HIGHWAY, provided by Anthony Eli Rasch - sapplify ("sapplify", "we", "us"). By downloading or using HIGHWAY, you agree to these terms and the HIGHWAY Privacy Policy. If you do not agree, do not use the game.
2. The game
HIGHWAY is a mobile driving game. You may play without an account. Every car, paint, and powerup can be earned through play. The game has no subscription and no paywall. It includes optional rewarded ads, HIGHWAY PLUS, and consumable coin packs, each described in the in-game store.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use HIGHWAY for personal, non-commercial entertainment, subject to these terms and the rules of the store from which you obtained it.
3. Eligibility
You must meet the age rating and legal age requirements that apply where you live and on the store you use. If you are not old enough to enter into these terms, a parent or legal guardian must review and accept them for you.
4. Rewarded ads
HIGHWAY offers only opt-in rewarded ads. You may be offered an ad to double a run's coins, continue one crashed run, or double a daily bonus. Watching an ad grants the stated reward only after the advertising provider reports a completed reward. If an ad is unavailable, dismissed, or not completed, no reward is due and the game remains playable.
Ads and their availability are provided by Google Mobile Ads and are subject to Google policies and the choices you make in the consent and tracking prompts. We do not promise that an ad will be available, that a particular advertiser will appear, or that watching an ad will always be possible.
5. Purchases and virtual items
HIGHWAY PLUS is a non-consumable purchase. It provides double run coins, a continue without an ad, and an exclusive paint. Coin packs are consumable purchases that add the stated number of coins to the local game save. Prices, currency, taxes, payment, refunds, and purchase authorization are handled by Apple or Google and shown by the relevant store before purchase.
HIGHWAY PLUS may be restored through the store's restore mechanism. Coin packs are consumable and are not restored after reinstalling the game. Virtual coins and items have no cash value, are not transferable, and cannot be exchanged for real money or goods. We may correct a technical error affecting a virtual balance or entitlement where required to keep the game functioning fairly.
6. Your game data
Your progress, coins, settings, and owned items are stored locally on your device. You are responsible for keeping your device and any device backups secure. We cannot recover a local game save that is deleted, lost, corrupted, or unavailable after an uninstall. Read the HIGHWAY Privacy Policy for the limited analytics, advertising, and purchase information the game processes.
7. Fair use
You may not use HIGHWAY to break the law, interfere with the game or its services, circumvent purchase or advertising systems, reverse engineer or modify the game except where mandatory law permits it, or use automated tools to generate gameplay, rewards, or purchases. We may suspend access where reasonably necessary to protect the game, players, service providers, or our legal rights.
8. Availability and updates
We may update, maintain, change, or discontinue HIGHWAY or a feature when reasonably necessary for security, legal compliance, technical operation, or product improvement. We do not guarantee uninterrupted availability of every feature, advertisement, store product, or platform integration. We will not remove a paid entitlement except where required by law, a refund applies, or the store revokes the transaction.
9. Our intellectual property
HIGHWAY, its code, artwork, audio, design, text, and trademarks are owned by sapplify or its licensors and protected by applicable intellectual-property laws. These terms grant a license to use the game, not ownership of it.
10. Disclaimers
HIGHWAY is provided for entertainment. To the maximum extent permitted by law, it is provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, availability, or error-free operation. Nothing in these terms removes consumer rights that cannot legally be excluded.
11. Liability
To the maximum extent permitted by law, sapplify is not liable for indirect, incidental, special, consequential, or punitive losses, including loss of game progress, virtual items, profits, or data. Our total liability for claims arising from HIGHWAY will not exceed the greater of the amount you paid for HIGHWAY purchases in the 12 months before the claim or EUR 50.
Nothing in these terms limits liability for fraud, intentional misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence, or any liability that mandatory law does not allow us to limit.
12. App Store and Google Play
If you download HIGHWAY from Apple, Apple is not responsible for the game, its support, or claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If you download HIGHWAY from Google Play, Google is not responsible for the game, its support, or claims relating to it. Your use of the store and all payments are also subject to the applicable Apple or Google terms.
13. Changes to these terms
We may update these terms when the game, our legal obligations, or our services change. We will publish the updated terms here and change the last-updated date. If a change is material, we will provide notice where required by law. Continuing to use HIGHWAY after the effective date means you accept the updated terms, unless applicable law requires another form of consent.
