If you connect a Sapplify Account

If you connect a Sapplify Account to sBudget, the Sapplify Account Privacy Policy and Sapplify Account Terms of Service additionally apply to your use of account-related features (sign-in, profile, cross-device sync, Sync subscription).

1. Introduction and Acceptance

In short: By using sBudget, you agree to these terms. The app works offline by default with a free tier. sBudget Pro is a one-time purchase for multiple accounts, recurring transactions, and custom categories. Sapplify Sync is a separate, optional subscription that enables cross-device sync (terms in the Sapplify Account Terms of Service).

Welcome to sBudget ("we," "our," or "the App"). These Terms of Service ("Terms") govern your use of the sBudget mobile application ("the Service"). By downloading, installing, or using sBudget, you agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.

These Terms constitute a legally binding agreement between you and:

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify you of material changes through the App or other appropriate means.

2. Description of Service

sBudget is a privacy-focused personal finance and budget tracking application designed to help users:

  • Track income and expenses across multiple accounts
  • Create and monitor budgets by category
  • Organize transactions with customizable categories
  • Set up recurring transactions
  • View financial analytics and reports
  • Export data in standard formats (JSON, CSV)

2.1 Local-First Architecture

By default, sBudget operates entirely on your device with local data storage. Your financial data does not leave your device unless you connect a Sapplify Account and enable Sapplify Sync.

2.2 Optional Sapplify Sync

Users may optionally subscribe to Sapplify Sync to keep sBudget data synchronized across devices. Sapplify Sync is a separate, suite-wide subscription tied to your Sapplify Account; its terms (pricing, trial, renewal, refund, withdrawal rights, lapse) are in the Sapplify Account Terms of Service §8.

2.3 What sBudget Is NOT

sBudget is a personal budgeting tool and is NOT:

  • A banking application
  • A payment processing service
  • A financial advisory service
  • Connected to your bank accounts
  • An investment management tool

3. User Eligibility

3.1 Age Requirements

To use sBudget locally, you must be at least 13 years old. To create a Sapplify Account (required for Sapplify Sync), you must be at least 16 years old; see the Sapplify Account Terms of Service §4.

The local-only features of sBudget can be used without providing any personal information.

3.2 Account Registration

Account registration is handled at the Sapplify Account level, not within sBudget. If you create a Sapplify Account, you agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account

3.3 One Account Per Person

Each Sapplify Account is for a single individual. You may not share your account credentials with others or create multiple accounts for the same person.

4. Privacy and Data Storage

4.1 Privacy Policy

Your privacy is important to us. Our collection, use, and protection of your data is governed by the sBudget Privacy Policy (for what sBudget does locally) and, if you have connected a Sapplify Account, the Sapplify Account Privacy Policy (for account-level processing). Both are incorporated into these Terms by reference.

4.2 Local Data Storage

By default, all your financial data is stored locally on your device using:

  • SQLite Database: For transactions, accounts, categories, and budgets
  • Shared Preferences: For app settings
  • Secure Storage: For authentication tokens (when signed in)

This local storage is strictly necessary for providing the budgeting service you requested.

4.3 Server-Side Storage (Sapplify Sync)

If you enable Sapplify Sync, your data is stored on Sapplify Account servers in Frankfurt, Germany (EU). Encryption in transit, encryption at rest, and per-user data isolation are handled at the account level; see the Sapplify Account Privacy Policy §9.

4.4 Your Data Rights

You retain full ownership of your financial data. You may:

  • Export your data at any time in JSON or CSV format
  • Delete your local data through the app
  • Delete your Sapplify Account from inside sBudget to remove all server-side data
  • Use the app without creating an account

5. Financial Information Disclaimer

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY.

5.1 Not Financial Advice

sBudget is a personal budgeting and expense tracking tool. The App does NOT provide:

  • Financial advice or recommendations
  • Investment advice
  • Tax advice
  • Legal advice
  • Professional accounting services

Any information, reports, or analytics provided by sBudget are for informational purposes only and should not be construed as professional financial advice.

5.2 Consult Professionals

For financial decisions, tax planning, investment strategies, or legal matters, you should consult with qualified professionals such as:

  • Certified financial planners
  • Tax advisors or accountants
  • Investment advisors
  • Legal professionals

5.3 Accuracy of Data

You are solely responsible for the accuracy of the financial data you enter into sBudget. The App performs calculations based on the data you provide. We do not verify, validate, or guarantee the accuracy of:

  • Transaction amounts you enter
  • Category assignments
  • Budget calculations based on your data
  • Any reports or analytics generated from your data

5.4 No Bank Connection

sBudget does not connect to your bank accounts, credit cards, or any financial institutions. All data entry is manual. We do not have access to your actual bank balances or transactions.

6. Pro Purchase & Sapplify Sync

6.1 Free Features

sBudget offers a free version with core budgeting functionality:

  • Add unlimited transactions
  • Budget creation and tracking
  • Analytics and insights
  • Transaction history
  • Default categories
  • Dark mode
  • Data export (JSON, CSV)
  • Full offline functionality

6.2 sBudget Pro (One-Time Purchase)

The following features are available through a one-time Pro purchase:

  • Multiple Accounts: Create and manage multiple accounts (e.g., "Personal", "Business", "Savings")
  • Recurring Transactions: Set up automatic recurring income and expenses
  • Custom Categories: Create and customize your own income and expense categories

Pro is a per-app, lifetime purchase that does not expire or require renewal and does not require a Sapplify Account.

6.3 Sapplify Sync (Subscription)

Sapplify Sync is a separate, suite-wide subscription that enables cross-device sync for every Sapplify app you have signed into, including sBudget. The full terms (pricing, free trial, auto-renewal, cancellation, refunds, price changes, the EU 14-day withdrawal waiver, lifetime plan, grace period, and effect of lapse on your data) are in the Sapplify Account Terms of Service §8.

6.4 Payment Processing

All payments are processed through:

  • Apple App Store for iOS users
  • Google Play Store for Android users

We do not collect, store, or process your payment information directly. All billing is handled by Apple or Google according to their respective terms.

6.5 Refunds

Refund requests are handled by Apple or Google according to their refund policies. We do not process refunds directly. Contact Apple Support or Google Play Support for refund inquiries.

6.6 Pro Price Changes

We may change Pro purchase prices with reasonable notice. Purchases already made are not affected.

7. Intellectual Property

7.1 Our Intellectual Property

The App, including its code, design, graphics, interface, and content, is owned by Anthony Eli Rasch - sapplify and protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove any copyright or proprietary notices
  • Use our trademarks without permission

7.2 Your Content

You retain full ownership of the financial data you enter into sBudget. We do not claim any intellectual property rights over your data.

7.3 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

7.4 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us a perpetual, royalty-free license to use and incorporate such feedback without obligation to you.

8. Prohibited Uses

You agree NOT to use sBudget to:

  • Violate any applicable laws or regulations
  • Track finances for illegal activities, including money laundering
  • Infringe on the rights of others
  • Attempt to gain unauthorized access to our systems or other users' data
  • Interfere with or disrupt the Service
  • Use automated systems to access the Service without permission
  • Resell, redistribute, or commercially exploit the Service
  • Use the App in any way that could damage our reputation

Violation of these prohibitions may result in immediate termination of your account and access to the Service.

9. User Responsibilities

9.1 Data Accuracy

You are responsible for:

  • The accuracy of all financial data you enter
  • Regularly reviewing your entries for errors
  • Correcting any mistakes in your data

9.2 Data Backup

We strongly recommend:

  • Regularly exporting your data as a backup
  • Keeping exported backups in a secure location
  • Testing your backups by importing them

Even with Sapplify Sync enabled, maintaining local backups is your responsibility.

9.3 Account Security

You must:

  • Keep your Sapplify Account credentials secure
  • Use secure, unique passwords (or your Apple/Google account if you sign in through them)
  • Enable two-factor authentication where available
  • Sign out from shared or public devices

9.4 Lawful Use

You agree to use sBudget only for lawful purposes and in accordance with these Terms.

10. Updates and Modifications

10.1 App Updates

We may release updates to:

  • Fix bugs and improve stability
  • Add new features
  • Improve performance
  • Address security issues
  • Ensure compatibility with new operating system versions

Some updates may be required for continued use of the App or Sapplify Sync service.

10.2 Terms Updates

We may modify these Terms at any time. Changes will be effective when posted. We will notify you of material changes through:

  • In-app notifications
  • Email (if you have a Sapplify Account)
  • Update to the "Last updated" date

Continued use after changes constitutes acceptance.

10.3 Feature Changes

We reserve the right to:

  • Add, modify, or remove features
  • Change the user interface
  • Update pricing for new Pro purchases

Existing Pro purchasers will retain their Pro features permanently. Sapplify Sync subscribers will maintain access to Sync for the duration of their subscription per the Sapplify Account Terms of Service §8 and §15. Specific implementations may evolve over time.

10.4 sBudget Pro Continuity (EU Digital Content Compliance)

In accordance with EU Digital Content Directive (EU) 2019/770 and related consumer protection laws, we commit to the following for sBudget Pro users who have made a one-time purchase:

  • Minimum conformity period: The App will remain functional and "in conformity" for a minimum of two (2) years from your date of purchase, subject to operating system compatibility
  • Continued access: If we discontinue active development, Pro users will retain access to the last compatible version of the App for as long as it remains compatible with their device's operating system
  • No forced obsolescence: We will not intentionally disable or degrade functionality for Pro users who have paid for the App
  • Data export: In the event of discontinuation, we will provide at least 90 days advance notice and ensure data export functionality remains available during this period

This commitment does not extend to compatibility issues caused by third-party operating system updates (iOS, Android) that are beyond our control. For Sapplify Sync subscription and lifetime customers, the equivalent commitments are in the Sapplify Account Terms of Service §15.

10.5 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to cloud services. The local functionality of the App will continue to work offline.

11. Disclaimers

11.1 "As Is" Basis

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

11.2 No Warranty

To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF DATA
  • UNINTERRUPTED OR ERROR-FREE SERVICE

11.3 Third-Party Services

We are not responsible for:

  • Apple App Store or Google Play Store policies or availability
  • Sapplify Account or Sapplify Sync availability (governed separately by the Sapplify Account Terms of Service)
  • Third-party operating system bugs or issues
  • Internet connectivity issues

You acknowledge that Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the App.

11.4 Data Loss

While we take reasonable precautions, we cannot guarantee against data loss. You are responsible for maintaining backups of your data.

11.5 Sync Conflicts

We are not responsible for any data inconsistencies that may occur due to synchronization conflicts across multiple devices. While we implement conflict resolution strategies, simultaneous edits on different devices may result in unexpected data states.

11.6 App Store Provisions

The following provisions apply to the extent you downloaded the App from the Apple App Store or Google Play Store:

  • Third-Party Beneficiary: Apple Inc. and Google LLC are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple and Google shall have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
  • Product Claims: sapplify, not Apple or Google, is solely responsible for the App and its content. Any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation, are the sole responsibility of sapplify.
  • Intellectual Property Claims: In the event of any third-party claim that the App or your use of the App infringes a third party's intellectual property rights, sapplify, not Apple or Google, shall be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

12. Limitation of Liability

12.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SAPPLIFY, ITS DEVELOPER, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, or data
  • Business interruption
  • Financial decisions made based on App data
  • Costs of substitute services

This applies regardless of the theory of liability (contract, tort, or otherwise).

12.2 Maximum Liability

Our total liability for any claims arising from your use of the sBudget app itself shall not exceed the greater of:

  • The amount you paid us for sBudget Pro in the 12 months preceding the claim, or
  • EUR 50 (fifty euros)

This cap applies to claims arising from your use of the sBudget app. For claims arising from your Sapplify Account or the Sapplify Sync subscription, the separate cap in the Sapplify Account Terms of Service §13 applies.

12.3 Essential Purpose

These limitations apply even if any remedy fails of its essential purpose.

12.4 Savings Clause (EU/Slovak Law)

Nothing in these Terms shall limit or exclude our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Gross negligence (hruba nedbanlivost) or intentional misconduct (umyselne konanie)
  • Any other liability that cannot be limited or excluded under the laws of the Slovak Republic or applicable EU consumer protection laws, including the Digital Content Directive (EU) 2019/770 as amended

This savings clause takes precedence over any other limitation of liability provision in these Terms to the extent required by mandatory law.

13. Indemnification

You agree to indemnify, defend, and hold harmless sapplify, its developer, affiliates, and service providers from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Financial decisions you make based on data in the App
  • Your negligence or misconduct

We reserve the right to assume exclusive defense of any matter subject to indemnification by you, at your expense.

14. Termination

14.1 Termination by You

You may stop using sBudget at any time by:

  • Uninstalling the App (removes local data)
  • Deleting your Sapplify Account from inside sBudget (removes all server-side data across every Sapplify app)
  • Canceling your Sapplify Sync subscription separately in your store's subscription settings

14.2 Termination by Us

We may suspend or terminate your access to the Service:

  • For violation of these Terms
  • For suspected fraudulent or illegal activity, based on credible reports or evidence
  • If required by law or valid legal process
  • If you fail to pay subscription fees
  • If we discontinue the Service (with reasonable notice)

Note: We do not actively monitor or access your local or server-side data. Any action taken for suspected illegal activity will be based on credible external reports, legal requests, or evidence of Terms violations through our systems.

14.3 Effect of Termination

Upon termination:

  • Your license to use the App ends
  • Sapplify Sync access is revoked
  • You should export any data you wish to keep before termination
  • Local data remains on your device unless you uninstall the App

We are not responsible for data loss if you do not export your data prior to account termination.

14.4 Survival

Sections that by their nature should survive termination will survive, including: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with the sBudget Privacy Policy and (where applicable) the Sapplify Account Terms of Service and Privacy Policy, constitute the entire agreement between you and sapplify regarding the Service.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.

15.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights, except for Apple Inc. and Google LLC as set forth in Section 11.6 (App Store Provisions).

15.6 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

15.7 Language

These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version prevails.

16. Governing Law and Disputes

16.1 Governing Law

These Terms are governed by the laws of the Slovak Republic, without regard to conflict of law principles. This does not affect your mandatory consumer protection rights under EU law, which may provide additional protections regardless of the governing law.

16.2 Jurisdiction

For users in the European Union, any disputes shall be subject to the jurisdiction of the courts in Slovakia, unless mandatory consumer protection laws in your country of residence provide otherwise.

16.3 Dispute Resolution

Before initiating any formal dispute, you agree to contact us first at contact@sapplify.com to attempt to resolve the issue informally. We will work with you in good faith to reach a fair resolution.

16.4 EU Online Dispute Resolution

If you are a consumer in the EU, you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16.5 Supervisory Authority

For data protection matters, you may lodge a complaint with your local data protection supervisory authority. Our lead supervisory authority is:
